Difficult to know but they seem to have some pretty hard hitting legal phraseology behind it all. I think they would try anything to get the Us market back on board as think of the profits that they could gain the traffic on Pokerstars may be good but they know that
1)Us players will like the fact the site has x number of traffic and want to rejoin in big numbers
2) If the US markets that run poker currently are in the the top ten for traffic it begs the question of that must be an awful lot of custom Pokerstars is probably first but they have such a wide number of countries to get players from maybe by having US players they're peak traffic goes up a 1/3 or a quarter that's a huge payout.
I think wherever they deem they can make x amount of money at y amount of cost for z amount of risk where X is easily the bigger they will tooth and nail to try and get it overturned.
